Region 5 RAC Audit Contract being Challenged

Due to a post-award protest filed at the Government Accountability Office (GAO), CMS has delayed the commencement of work under the national DMEPOS/HH&H, Region 5, Recovery Audit contract, according to CMS’ website. The contract, which was awarded to Connolly as the nationwide RAC auditor for Home Health, Hospice and DME, will delay any RAC activity under this contract until the protest is heard and the GAO makes a decision.
The contract was awarded to Connolly in late December, and is being protested by another company, which is not unusual. For example, NAHC saw protests quite frequently when MAC contracts were first being awarded. NAHC does not know - and will likely never be privy – to the facts that form the basis of the challenge. Regardless of the reason, this process can take some time, several months at the least, before it’s resolved.
In the meantime CMS can not move forward with RAC audits under the Connolly award as the nationwide RAC auditor for Home Health, Hospice, and DME.
Back in August of 2014, CMS posted the following “due to the continued delay in awarding new Recovery Auditor Contracts, the CMS is initiating contract modifications to the current Recovery Auditor contracts to allow the Recovery Auditors to restart some reviews. Most reviews will be done on an automated basis, but a limited number will be complex reviews of topics selected by CMS”.
