Congressional Letter Opposing Face-to-Face Documentation Requirements Sent to CMS Administrator

Last week, a bipartisan group of 75 Members of Congress sent a letter to Marilyn Tavenner, the Administrator for the Center for Medicare and Medicaid Services (CMS), on the overly complicated and burdensome face-to-face (F2F) physician encounter documentation requirements promulgated by CMS.  The letter asserts that these documentation requirements go well beyond what the Affordable Care Act (ACA) required.

The letter was circulated by Representatives Tom Reed (R-NY), Paul Tonko (D-NY), Chris Smith (R-NJ), and Robert Andrews (D-NJ), and was sent to every congressional office asking for additional Member support.

New York and New Jersey NAHC members initiated the sign on letter and NAHC members and advocates were integral in the effort to get the 75 lawmakers to add their name to the letter.

The final 75 lawmakers who signed the letter are Democrats and Republicans from every region of the country representing rural, urban and suburban populations. In the letter, the lawmakers express their primary concerns with the F2F encounter requirement:

Deadline for Registration to Participate in the MAC Satisfaction Indicator (MSI) is Monday, Sept. 30

CMS strives to continually refine its processes, systems and services in the pursuit of excellence which is our commitment to continuous improvement. In living this commitment, we are providing a tool, the Medicare Administrative Contractor Satisfaction Indicator (MSI), to measure the level of satisfaction providers and suppliers experience with their Medicare Administrative Contractors (MACs).  The MSI allows providers the opportunity to influence CMS' understanding of Medicare contractor performance.  The goal of the MSI is to evaluate these experiences and determine the key drivers of customer satisfaction.  In addition, CMS will use the results of the MSI to monitor trends, improve oversight and increase the efficiency of the Medicare program.

NAHC Responds to Methodological Issues in MedPAC’s Home Health PPS Comments

The National Association for Home Care & Hospice (NAHC) recently addressed what it sees as methodological issues in MedPAC’s home health rebasing proposal stating that:

“The Medicare Payment Advisory Commission (MedPAC) recently submitted comments to the Centers for Medicare and Medicaid Services (CMS) on the Home Health Prospective Payment System (HHPPS) Proposed Rule for CY 2014.  In its comments, MedPAC appears to rely on data that are incomplete and outdated. 

Most alarming of all, however, is the assertion that “targeted payment policies” will be considered – but only after loss of access to care has occurred.

It will take several years for MedPAC to identify the expected care loss and for Congress to enact corrective action. Millions of homebound seniors and disabled individuals will suffer needlessly due to the flawed analyses that are the foundation of CMS’ unsustainable proposed rebasing adjustment.”
