Littler has partnered with the Home Care Association of America (HCAOA), the National Association for Home Care & Hospice (NAHC) and the Private Duty Home Care Association (PDHCA) to provide a webinar series to assist home health, hospice and home care providers to navigate through the complex and seemingly ever-changing legal landscape brought about by the COVID-19 pandemic.

This Thursday, August 6th at noon EDT we will be hosting a special session to discuss an important update in the lawsuit brought by the State of New York challenging the U.S. Department of Labor’s Final Rule implementing the FFCRA’s paid leave provisions – the Emergency Family and Medical Leave Expansion Act (EFMLEA) and the Emergency Paid Sick Leave Act (EPSLA).

On Monday August 3rd, the United States District Court of the Southern District of New York issued a decision vacating the provisions of the Final Rule related to the “work-availability” requirement, the definition of “health care provider,” the requirement that an employee secure employer consent for intermittent leave, and the requirement that an employee provide certain documents before taking leave. Please join Littler Attorneys Angelo Spinola and Will Vail as they discuss key takeaways and the impacts of the Court’s decision on the home health, hospice and home care industries.

Our Home Care Industry Update series aims to bring the industry together for real-time advocacy and legal updates, practical guidance in light of the same, and provide a forum for answers to your most pressing questions.
